We disclaim all warranties or guarantees and conditions with regard to information posted on this website and all parts sold, including all implied warranties or guarantees and conditions of merchantability, condition of parts, performance gains, fitness for a particular purpose, title and non-infringement. Buyer understands and agrees all parts on xcceleration.com llc have been designed and are intended for off highway application only. All engine modification components, except those that are exempt, have been designed and are intended for off-highway application. These components are for racing vehicles only, which may never be used on public roads and highways. Federal and many state laws prohibit the removal, modification, or rendering inoperable of any device or element of design affecting vehicle emission or safety in a vehicle used on public highways. Violation of such laws may subject the owner or user to a fine or penalty. Installation of this part may void the warranty coverage, if any, on your vehicle. Vehicles modified by the use of performance parts may no longer be lawfully used on public highways. User assumes all cost and risks associated with these items. By purchasing performance parts from xcceleration.com llc, the buyer confirms all parts are for off-road use only. Installation of these parts on a vehicle intended for use on public roads may violate state or federal laws and regulations including those relating to emissions requirements and motor vehicle safety standards. In addition, buyer understands and agrees xcceleration.com llc is not liable for any special, indirect or consequential damages or any damages whatsoever, whether in an action of contract, negligence or other tortuous action or action by any state or federal agency, arising out of or in connection with information available from this web site or the purchase, use and installation of any parts purchased from xcceleration.com llc and you the customer release xcceleration.com llc of all responsibility for legal issues resulting from use, abuse, negligence or misuse thereof, whatsoever!

Payment Information and Options:

PAYMENTS SHALL BE VISA / MC / AMEX, IN FULL AT TIME OF ORDER FOR USA CUSTOMERS OR BUYERS. PERSONAL OR BUSINESS CHECKS WILL NOT BE ACCEPTED. ALL ORDERS FOR ENGINES/TRANSMISSIONS/GEARS SHALL BE PAID VIA WIRE TRANSFER OR MONEY ORDER ONLY, IN ADVANCE. ALL CREDIT CARD ORDERS WILL BE BILLED IMMEDIATELY FOR APPROVAL. All orders placed with Xcceleration.com llc, either by phone, fax, mail or online constitutes the acknowledgment and acceptance of all conditions listed on Xcceleration.com llc. It is the responsibility of the customer/installer to verify the application of all parts before installation, not Xcceleration.com llc. To prevent credit card fraud, we will ONLY SHIP ORDERS TO THE CREDIT CARD'S BILLING ADDRESS.
In order for us to ship a package to your school, work or whereever (an address that is not the billing address of your credit card) please contact your credit card's customer service department and request that the delivery address be added as a "secondary billing address" for your credit card. You can then include the delivery address as your billing address on the order form. Also please remember always to provide your credit card's customer service number!
FOR ALL INTERNATIONAL ORDERS (OUTSIDE OF THE UNITED STATES) THESE ORDERS HAVE TO BE PREPAID VIA BANK WIRE TRANSFER DIRECT TO XCCELERATION.COM LLC ACCOUNT. THERE WILL BE NO EXCEPTION TO OUR PAYMENT POLICY.

We also accept money orders such as US Postal, Western Union, Certified bank money orders, and bank wire transfers. There is a mandatory wait of 15 working days for any money orders, or certified bank checks to clear before order is shipped. Why? Because some XXXX people who decide not to work for a living, want to steal, and like to fabricate counterfeit checks on their computers and try to use them as real, or get stolen checks and try to reprint them as real with fraudulent information. Anyone attempting bank fraud or credit card fraud is committing a federal felony and will be prosecuted to the full extent of the law. This 2 week waiting period is the approximate time it will take for the bank to clear the money order / certified bank check. As stated, we accept Master Card, Visa and American Express. There is a 3% conveyance fee added to the total for all credit card orders. Sales tax will be added to the grand total where appropriate. IMPORTANT: - All credit card orders will be immediately charged for approval. If your Billing address is to a PO BOX, APO and FPO, these orders have to be PREPAID via Money Order or Cashier's Check only. All credit card order shipments will only be sent to the billing address that the credit card statement is mailed to. Shipments will not be sent to any other addresses whatsoever! If customers request package to be sent to address other than billing address, then you MUST send a money order, certified cashier's check, or wire transfer. Only the customer whose name is shown on the credit card may call to place any order! This means, do not use a credit card if your full birth name is not on it! Do not use your mother's, father's, sons, daughters, girlfriends, boyfriends, sisters, brothers, cousin, best friend, good friend, your boss', co-worker's, baby's momma's, etc... under any circumstances! We will call and verify! Even if the other person gives you "so called permission" to use the card, this is deemed fraudulent activity and may result in severe consequences! So please do not waste our time and we shall not waste yours. ALL INTERNATIONAL ORDERS (OUTSIDE OF THE UNITED STATES) THESE ORDERS HAVE TO BE PREPAID VIA BANK WIRE TRANSFER DIRECT TO XCCELERATION.COM LLC ACCOUNT. THERE WILL BE NO EXCEPTION. We can supply more details upon request. Before sending any money order or certified bank check; please call, fax, or e-mail Xcceleration.com llc for total with shipping and handling to your door. Upon sending payment through US Postal, UPS, Fed-Ex, etc.. Please include payment, full name, shipping address, contact phone number, full description of part(s) being ordered; and full description of vehicle. Ex: 1999 Subaru 2.5RS Coupe - manual transmission. Remember, if sending any monies through any services above-mentioned, please send certified. Please do not send any cash via mail. This protects you, so if your money order or check gets lost, you have some sort of proof!

Xcceleration.com llc does not inventory any parts. All parts are subject to availability. Once parts availability has been determined, order processing and shipping will be arranged. Please make sure everything is in satisfactory condition upon delivery. Please open your order immediately upon receipt. Check your invoice for backordered items. Backorder parts will come in a separate box. Inspect packing list with the products shipped. If shortages are found, please inspect box for split, crack or tears. Notify Xcceleration.com llc immediately. Tracking numbers will not be given under any circumstances! If you absolutely have to know where your package is; you can call, fax, e-mail us and we will track your packages for you. If calling, please have full name, description of parts ordered and call back number ready. Approximate 1-hour wait before a Xcceleration.com llc representative can give you tracking number if calling during business hours. No changing addresses after package is accepted under any circumstances! If we find out that you request an address change for your shipment, we shall issue a call tag and re-route your shipment back to Xcceleration.com llc, and cancel your order!!!! This is deemed fraudulent activity and we must take all necessary precautions to safeguard our business, and other honest customers. All USA shipments are sent UPS ground-trac, insured and with "signature required" on all shipments. If All Canadian shipments are sent Standard (Ground) with "signature required." All body kits, racing hoods, most racing seats, and parts of similar excessive dimensions cannot go UPS. They are too big! We use different freight companies in which service is approx. 7 - 10 working days cross-country. All packages are sent fully insured and you must notify us for all tracking information. Claims for damage during shipment must be made by you to the delivering carrier within three (3) days. Xcceleration.com llc cannot initiate claims for you. Please save all original packing materials such as box, box filler, labeling, tape or claim may not get fulfilled upon request. (This includes body kit, and racing hood claims too!) After claim is made and the motions are completed entirely, only exchange of same part that was originally damaged is acceptable by the manufacturer. Buyer shall pay shipping fees if product needs to be sent back to factory for repairing, and Buyer shall also pay all shipping costs on all products returned for any reason to Xcceleration.com llc. Alternative shipping is available for other US territories and all outside countries in any continent on the face of this earth. Not all-shipping rates are readily available for boat or air to other countries. We can get freight estimates only if requested and provided you call, e-mail, or fax us your full name, address, and appropriate postal code(s). UPS is available worldwide, but is extremely costly as it goes air only and Body kits, hoods, etc. and other large dimensional parts must go by freight. Other alternatives for customers outside USA are to contract you're own shipping company to pick up the freight. REFUSED SHIPMENTS: Any refused shipments do not constitute the right to a refund or credit. DAMAGES: We carefully inspect every item before shipping. Thus all damage claims must be made to the shipping carrier, although we will assist you as much as we can in the damage claim process, we will not be responsible for the outcome of the claim. All SALES ARE FINAL. It is the customer's responsibility to make all arrangements for shipment acceptance. It is company policy, if the shipment is refused, the order shall be considered canceled and all monies previously deposited shall be forfeited to Xcceleration.com llc. BACK ORDER POLICY: If an item is not in stock, we will hold a 'Back Order' for you and ship the item as soon as it becomes available. If Xcceleration.com llc deems there will be a long delay, we will advise you of that fact. If you do not wish to wait for back ordered items, we will cancel the items you requested upon receiving written instructions to do so and issue a credit minus any fees charged Xcceleration.com llc by Manufacturers/Distributors/Credit Card Companies/Banks or any other company necessary to accomplish Buyer's cancellation request prior to product(s) manufacturer and/or shipment to Xcceleration.com llc. and Xcceleration.com llc payment for said product(s).

Returns - Defective Products for Exchange / Replacement only:

Returns are only to exchange defective products, not for Credits, Store Credits or Refunds. Authorization to exchange (EXCHANGE AUTHORIZATION NUMBER - RA.#) any and all defective products must be obtained by the Buyer from Xcceleration.com llc in advance and must be made within (3) days of receiving the product. Please write this number clearly on the outside of the returning package. All returns for replacement must be received by Xcceleration.com llc within 7 calendar days after the EA. number has been issued. The Exchange Authorization Number does not imply an automatic replacement, exchange, but only that we will inspect the defective merchandise based on your claim. All returned products to Xcceleration.com llc for exchange / replacement are subject to 35% handling fee at Xcceleration.com llc's discretion. Buyer must pay for all Shipping / Handling fees on any and all returns to Xcceleration.com llc. All defective products returned must be in the original manufacturer carton, in the same condition as it was originally delivered to the Buyer. Only the original Buyer may request for an exchange of products. All warranty cards and other such items must be included with the product being returned. Defective items shall be exchanged for the same item directly from the manufacturer, not Xcceleration.com llc and only after warranty has been cleared from original manufacturer will the Buyer receive product back. After receipt of goods, Xcceleration.com llc shall inspect the goods to determine the exact quantity and condition of goods received. It is the responsibility of the customer / installer to verify the correctness of size and application of the parts before installation. If Xcceleration.com llc does not accept the goods as returnable / exchangeable for any reason, Buyer must accept incurred all costs. Wheels and Tires, which have been mounted or used, are not returnable under any condition. All Orders are considered Special Orders, Custom Made Orders, and all Electrical or Mechanical parts are not returnable. No returns whatsoever will be valid if the damage is caused by customer abuse, negligence, mishandling and/or poor installation. PLEASE REMEMBER ALL SALES ARE FINAL. ORDER CAREFULLY! There will be no exceptions to this policy.

Credits: Only Store Credits

Only a store credit shall be issued to the Buyer, if the Buyer's credit request is received in writing prior to product(s) manufacturer, distributor, and/or agent's shipment to Xcceleration.com llc or Customer / Buyer and said manufacturer, distributor, and/or agent's billing Xcceleration.com llc for said product(s). Any store credits issued shall be minus any fees charged Xcceleration.com llc by Manufacturers/Distributors/Agents/Credit Card Companies/Banks or any other company necessary to accomplish Buyer's cancellation request, including any restocking fees Xcceleration.com llc may incur. Once the product(s) have been delivered to the Buyer, only our policy for 'Defective Products for Exchange / Replacement' shall be in effect. There will be no exceptions to this policy.

Orders / All Orders are Considered Special Orders:

All orders / special orders and require a nonrefundable prepayment of 100% of total costs at time of order. If there is any cancellation for any reason by the Buyer, that prepayment is forfeited immediately to Xcceleration.com llc at Xcceleration.com llc's discretion and/or any restocking fees Xcceleration.com llc deems necessary. Xcceleration.com llc shall not be responsible for any late shipments. All shipping dates given are approximate. Buyer shall not be entitled to charge backs, reductions of price, or other offsets as result of late shipment or failure to deliver in estimated time of delivery. If order/special order item(s) are left over 60 days from time of Xcceleration.com llc receiving parts in stock; and Buyer has not made any attempt whatsoever to claim their order, then the order shall be considered canceled and all monies previously deposited shall be forfeited to Xcceleration.com llc. Exception: calculation/credit may be requested by the Buyer in writing under the terms and conditions of the section heading: 'Credits' seen above.

Contingencies:

Xcceleration.com llc shall not be liable for any failures to produce product to Buyer when the cause of such failure is the result of the forces of nature, labor disputes, supplies or materials shortage, acts of local, state, national, civil, or other authorities or public agencies; utility or communication failures, accidents, strikes, transportation problems, or any act or cause that does not normally occur in the ordinary course of Xcceleration.com llc's business.

Warranty /Liability:

DISCLAIMER OF WARRANTIES NOTE: All products are designed for off-road use, and considered racing parts, as such do not carry any warranty or guarantee either expressed or implied by Xcceleration.com llc. Xcceleration.com llc gives no warranties or guarantees, express or implied, including, but not limited to, the implied warranties or guarantees of merchantability, condition of parts and fitness for a particular purpose or performance gains. Xcceleration.com llc will not be held liable for any damages or labor, whatsoever, which are incurred directly or indirectly on the vehicles or operators or passengers of the vehicle. Prices are for "after the sale" accessories. Xcceleration.com llc's sole warranty for any and all products sold is set forth in the warranty documentation associated with the product from the Manufacturer. If a warranty or guarantee is available from the manufacturer, all warranty claims are the responsibility of the Customer / Buyer to pursue directly with the manufacturer of the product, not Xcceleration.com llc. No warranty or guarantee whatsoever will be valid if the damage is caused by customer abuse, negligence, mishandling and/or poor installation. All performance parts have been designed and are intended for off highway application only. By purchasing performance parts from this site, the Buyer confirms the parts are for off-road use only. Installation of these parts on a vehicle intended for use on public roads may violate state or federal laws and regulations including those relating to emissions requirements and motor vehicle safety standards. Federal and many state laws prohibit the removal, modification or rendering inoperative of any part or vehicle system affecting emissions or safety. Violations may result in a fine of up to $10,000 per vehicle. In addition, installation may void warranty coverage of your vehicle. Buyer confirms that all purchases will be for off-road use only and indemnifies Xcceleration.com llc from all actions, whatsoever. All product prices, availability and shipping costs are subject to change without notice. Shipping costs are calculated and billed at time of shipping. Xcceleration.com llc is not held responsible for any misconception or disappointments associated with any of these parts. All engine, exhaust, performance, body kits, racing hoods, and modification parts are legal in all 50 States for off-highway use only.

Body Kit / Aerodynamics:

Buyer fully understands that all body kits are sold "as is" with no warranty expressed or implied; due to the fact that most body kits are made of 100% fiberglass and most are imported from Asia (Japan / China / Taiwan / Korea). Buyer also understands that due to strict U.S. Federal and State Safety crash guidelines, Xcceleration.com llc is not responsible or liable for any damages or possible injury incurred upon possible accidents due to driver error, incorrect installations, bad judgment (cracking or breaking your aero parts) or act of nature / God, Allah, Jehovah, Buddha, etc... All body kits (aero components) are only recommended and legal to be used for off-highway use such as track racing or for exhibition show only! Buyer understands that all body kits (aero components) may need modifications for correct fitment such as removal of safety reinforcements, removal of factory bumper lights/side marker indicators, shaving, molding, etc. Because several of these kits are prototype and used on NON-USA vehicles that have much less safety standards/requirements in their respected country of origin. Buyer understands that all body kits (aero components) require some prep work before paint; we are not responsible for any extra-incurred fees, material fees, and storage fees for unexpected labor your body shop/paint shop charges the Buyer. We strongly RECOMMEND you only have highly skilled body shop / technician install and paint any body kit (aero components) for factory or show quality look. Not all body shops charge the same prices, or have the same quality work performed. We find that you get what you pay for! If any aero part(s) arrive damaged or cracked bad enough it cannot be repaired, you must contact Xcceleration.com llc immediately in order for claim to be processed and approved. Please refer to Shipping / Handling section of this page for further details involving claims.

Aftermarket Lightweight Racing Fiberglass & Carbon Fiber Hoods:

Buyer fully understands that all fiberglass & carbon fiber hoods or hoods made of similar lightweight materials are sold "as is" with no warranty expressed or implied, due to the fact all hoods are made of 100% fiberglass or a combination of fiberglass / carbon fiber. Most of these hoods are made in various local fiberglass factories, and also several are imported from Asia (Japan / China / Taiwan / Korea) which carry and set forth NO WARRANTIES whatsoever. Xcceleration.com llc is not responsible or liable for any damages or possible injury incurred upon possible accidents due to driver error, incorrect installations, bad judgment (cracking or breaking your hood) or act of nature / God, Allah, Jehovah, Buddha, etc.... All after market lightweight racing hoods are intended and recommended only for off-highway use such as track racing or exhibition show only! Buyer understands that all hoods are lightweight after market hoods and that these hoods are have no OEM specifications whatsoever. Most hoods come with stock latch and pre-tapped holes for easy installation. We strongly RECOMMEND that all customers purchase hood pins for safety reasons on ALL after market lightweight racing hoods. Xcceleration.com llc strongly recommends you purchase hood pins at your local automotive retailer. We strongly recommend all customers only have a highly skilled professional body shop / technician install and paint any hoods (that require paint) for factory or show quality look. Not all body shops charge the same prices, or have the same quality work performed. We find that you get what you pay for! If any hood arrives damaged or cracked bad enough it cannot be repaired, you must contact manufacturer immediately in order for claim to be processed and approved.

Installation Requests:

If the Customer has asked Xcceleration.com, llc to arrange for certain after-market parts to be built or installed or modified or fabricated through its strategic partners, then the Customer does understand the ramifications of having these modifications or performance after-market parts on their vehicle. Xcceleration.com, llc and its strategic partnersare not held responsible for any liability; misconception or disappointments associated with any of the Customer supplied parts and requests. Therefore, Xcceleration.com, llc and its strategic partners accepts no liability or makes no warranties, either expressed or implied, as to any matter whatsoever including without limitation, the condition of the Customer’s vehicle or the parts supplied by the Customer or the fitness for any particular purpose. The Customer shall indemnify Xcceleration.com, llc and its strategic partners against, and hold harmless from any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities, including attorney's fees, arising out of, connected with or resulting from, without limitation, service, manufacture, selection, delivery, possession, use, or operation of customer’s vehicle. It is further understood and agreed, only Xcceleration.com, llc supplied parts shall be used by its strategic partners, for the customer’s requests. All Xcceleration.com, llc invoicing shall reflect any strategic partners billing, as billing agent only. Any subsequent requests for work shall be directed to Xcceleration.com, llc specifically, not its strategic partners.
